Terms of Service

1. Acceptance of Terms

By downloading, installing, or using Diamond Coach ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a legally binding agreement between you and Diamond Coach ("we," "our," or "us").

2. Description of Service

Diamond Coach is a youth sports management platform that provides tools for coaches, and parents to manage team rosters, schedules, practice plans, lineups, and instructional video content. The App is intended for use by adults (18+) acting in a coaching or parental/guardian capacity within a youth sports organization.

3. Eligibility

You must be at least 18 years of age to create an account and use the App. By using the App, you represent and warrant that you are 18 or older and have the legal capacity to enter into these Terms. The App is not intended for direct use by minors; player profiles for minors are managed by authorized adult account holders.

4. Account Registration

To access the App's features, you must register for an account using a valid email address. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain the security of your account credentials and not share them with others.
• Notify us immediately of any unauthorized access to your account.
• Accept responsibility for all activities that occur under your account.

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent, abusive, or harmful behavior.

5. Permitted Use

You may use the App solely for lawful purposes related to managing youth sports teams. You agree not to:

• Use the App for any commercial purpose other than managing your own team(s).
• Upload, post, or share any content that is unlawful, offensive, defamatory, or infringes on any third party's rights.
• Attempt to gain unauthorized access to other users' accounts or any part of the App's backend systems.
• Use automated bots, scrapers, or other tools to extract data from the App.
• Reverse engineer, decompile, or modify any part of the App.
• Misrepresent your identity or affiliation with any team or organization.

6. User Content

You retain ownership of any content you submit to the App, including player data, schedules, practice plans, and linked media ("User Content"). By submitting User Content, you grant Diamond Coach a limited, non-exclusive, royalty-free license to store and display that content solely for the purpose of providing the App's services to you and your team.

You are solely responsible for the accuracy and legality of all User Content you provide. You represent that you have obtained all necessary consents (including parental/guardian consent where applicable) to submit information about minors.

7. Third-Party Content and Links

The App allows you to link or embed content from third-party platforms (e.g., YouTube, Instagram, Facebook, TikTok). Diamond Coach does not control, endorse, or assume responsibility for any third-party content. Your use of third-party platforms is governed by their respective terms of service and privacy policies.

8. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to the data practices described in our Privacy Policy.

9. Intellectual Property

All rights, title, and interest in and to the App — including its design, code, logos, and features — are owned by Diamond Coach. Nothing in these Terms grants you any right to use our trademarks, logos, or other proprietary materials without our prior written consent.

10. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

Diamond Coach is not responsible for any decisions made based on content within the App, including lineup decisions, practice plans, or player assignments.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DIAMOND COACH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, LOSS OF PROFITS, OR PERSONAL INJURY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE GREATER OF $50 OR THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless Diamond Coach and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including legal fees) arising out of your use of the App, your User Content, or your violation of these Terms.

13. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for any reason, including violation of these Terms. You may also delete your account at any time through the Settings page. Upon termination, your right to use the App ceases immediately. Sections that by their nature should survive termination will survive, including Sections 6, 9, 10, 11, and 12.

14. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Effective Date" at the top of this page and, for material changes, provide in-app notice. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which Diamond Coach operates, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the appropriate courts of that jurisdiction.
